Hot Yoga Brixton Terms and Conditions

1. WHAT WE MEAN WHEN WE SAY:
“Studio”, “Us” or “HYB” means Hot Yoga Brixton Limited trading as Hot Yoga Brixton and its premises at 372A Coldharbour Lane, London SW9 8PL.
“App” means our mobile app available via Google Play or App Store
“Class”, “classes”, “workshop” means any class or workshop provided by or on behalf of Hot Yoga Brixton.
“Member” means any person who has completed a registration form, has taken or booked a class.
“Membership”, “rolling membership” or “package” means the different types of memberships that a member can purchase including but not limited to: Drop in, Hot U, First Membership and the 10 Class Card.
“Fees” means membership fees paid by the member.
“Website” means hotyogabrixton.com
“Terms”, “Terms and Conditions” or “T&Cs” means these terms and conditions.
The singular shall include the plural and vice versa where the context permits.

2. GENERALLY:
If you register, book or attend any of our classes or workshops you accept these terms and conditions.
We reserve the right to change these from time to time. Any changes will be published on our website. If you don’t accept changes you can terminate your membership without penalty within 30 days from the publishing of the changes. If you terminate your membership for this reason you will be refunded for the remainder of your membership accordingly to our refunds policy as outlined in these terms and conditions.
Our class schedule may vary time to time. We reserve the right to change our timetable periodically. If we reduce our timetable by more than 25% month to month or remove certain classes that you attend permanently you will be eligible to cancel your membership immediately and receive a partial refund in accordance with our refunds policy outlined in these terms and conditions.
You consent to photography or video of you being taken by HYB at any time while on our premises. We reserve the right to use these for promotional purposes. If you don’t agree with this please inform us in writing (info@hotyogabrixton.com).
Any disputes arising from these terms and conditions shall be governed by the laws of England and subject to the exclusive jurisdiction of the English courts.

3. MEMBERSHIP:
You become a member through registering via our app, website or in the studio and purchase of a membership (promotional and free memberships included).
Your membership is non-transferrable and assigned to yourself alone. We may ask you to show a photographic proof of identity.
You cease to be a member when your membership expires or is cancelled.
You must update your membership profile with up to date contact information including email address and phone number. By providing this you agree to be contacted for the purpose of your membership and accept all security risks involved in communicating via email. HYB will not be liable for any loss or damage suffered as a result of communicating with a member by email.
All communication regarding your membership administration needs to be conducted in a written form via email to info@hotyogabrixton.com. Membership administration instructions given verbally in person or on the phone are not binding and the studio doesn’t take responsibility for any loss or damages arising from such communication.
We reserve the right to expel from the studio, cancel membership or refuse to renew your membership if you don’t observe our terms and conditions or your conduct, in our reasonable opinion is damaging, threatening, offensive or creates health and safety risks for our staff, teachers or other members.

4. MEMBERSHIP TYPES:
HYB offers two types of memberships: rolling memberships (including but not limited to: Hot U and 5 class/month) and packages (including but not limited to: Drop In, 10 Class Card)

5. ROLLING MEMBERSHIPS:
Rolling membership is a monthly subscription membership continuing automatically until terminated by the member (unless minimum commitment applies). All our rolling memberships are self-cancelled by the member (unless minimum commitment applies).
Package is a bundle of class credits with a specified expiration period.
Hot U and 5 class/month are rolling memberships. They renew automatically in monthly intervals unless cancelled by you.
First Membership or Hot U membership can be cancelled anytime via our website. Cancellation doesn’t require any notice and there is no minimum subscription period for this membership.
Hot U 4 months commitment cannot be cancelled anytime. It will automatically renew for 4 months from activation date (1st class, to be taken within 60 days). It will keep rolling unless self cancelled. After the 4 month commitment period it can be cancelled anytime.
5 class card with 4 month commitment cannot be cancelled anytime. It will automatically renew for 4 months from activation date (1st class, to be taken within 60 days). It will keep rolling unless self cancelled. After the 4 month commitment period it can be cancelled anytime. No extension, top up or transfer of remaining classes.
Membership fees are non-refundable. In the event of you failing to cancel your membership before it renews we will not be able to offer you a refund of the charged membership fees.
If you face technical difficulties with cancelling your membership our team can help you with the cancellation if you email us on info@hotyogabrixton.com. Please allow 72 hours for this to be processed. If you notify us about your technical difficulties with less than 72 hours advance or after the membership fee was charged we will not be able to refund you.
If we fail to collect your membership fee we will try again within 24 hours. After the second failed attempt your membership will be automatically cancelled.
Rolling memberships come with one free freeze for up to 30 days per calendar year. Any subsequent freeze will be charged a £25 admin fee for any 30 day period. Medical freeze is free of charge and requires medical proof. Freeze cannot be backdated or start past your existing package expiry date.
In the event the studio is mandated to close temporarily for any reason outside our control your membership will be paused for the duration of the closure and will restart automatically when the studio reopens.
All other terms and conditions apply to these memberships.

6. PACKAGES:
Drop In and 10 and 20 Class Card are packages. They comprise a number of class credits and are subject to expiry periods.
Drop In is a single class credit package with 365 days expiry from the purchase date.
10 Class Card is a 10-credit package with 6 months expiry from the first class (to be activated within 365 days from purchase date).
20 Class Card is a 20-credit package with 9 months expiry from the first class (to be activated within 365 days from purchase date).
The expiry period of Class Cards can be extended. A 1 month extension fee (starting from the expiry date of the class card) can be purchased for £25. 

In the event the studio is mandated to close temporarily for any reason out of our control your package expiry date will be amended to reflect the duration of the closure.
All packages can be frozen for medical reasons. These freezes require medical proof.

7. CLASS BOOKINGS AND ADMISSION:
Classes can be booked by members with active memberships up to 7 days in advance.
Bookings are guaranteed up to 15 minutes before the class starts. If you don’t check in at reception 15 minutes before your class we may offer your spot to anyone else on a first come first serve basis.
Classes can be cancelled up to 4 hours before the class starts with no penalty.
If you cancel your class less than 4 hours before the class starts or don’t turn up for your class, we are unlikely to fill your spot. Therefore, we will either deduct a class credit from your package or charge a £10 late cancellation/no show fee if you have a rolling membership.
If you are late for your class you will not be allowed into the class that has already started for health and safety reasons.

8. WORKSHOP BOOKINGS:
Workshop tickets are valid for 12 months from the date of purchase.
Workshops can be cancelled up to 6 hours before the workshop start time. If you cancel with less notice, we are unlikely to fill your spot and will deduct your workshop credit.
In the event workshop is cancelled by the studio your workshop ticket will remain valid to use for any other workshop within 12 months or you will receive a full refund.

9. REFUNDS:
Membership fees are non-refundable.
Membership fee refunds permitted by these terms and conditions will be calculated by deducting the drop in rate for any classes attended using said membership from the original membership fee and will be processed within 30 days.
If you purchased your membership online you have 14 days to change your mind, also known as a cooling off period. If you visited the studio and took any classes within this period we will issue you a refund deducting the drop in value of the classes taken using the membership. To request a refund during cooling off period email info@hotyogabrixton.com. Your refund will be processed within 30 days.
Any equipment, accessory or product purchased in the studio may be returned within 14 days for exchange if it has not been opened, used or damaged. Faulty products will be replaced. In the event that replacement is unavailable refunds will be processed within 30 days.

10. HEALTH AND SAFETY AND PERSONAL BELONGINGS:
By attending our classes you accept that it involves intensive exercise in a heated room. By booking classes or workshops you warrant and represent that you are in a good physical condition.
Our staff are not medically trained and therefore are not qualified to assess whether you can engage in physical activity. If you are unsure about your health please consult your doctor.
You should not attend classes or workshops if you are suffering from or have symptoms relating to: low/high blood pressure, cardiac irregularities, any transmissible, infectious or contagious illness, disease, virus or other ailment or suffering from anything where there is a risk, however small, that such may be detrimental to the health and safety, comfort or physical condition of other members, members of staff, teachers or other guests or visitors to the Studio. Pregnant women need to talk to their doctor before practicing.
We provide lockable lockers for personal belongings. For privacy reasons we do not operate CCTV or any other form of monitoring in our changing rooms. You therefore leave your personal belongings in the changing room at your own risk.
Any property left behind will be kept for 7 days and then disposed of without notice.
If you are using the studio’s mat rental service you are required to use a suitable towel to cover the mat.

11. PROMOTIONAL MEMBERSHIPS AND CONCESSION MEMBERSHIPS:
Concession available up to 20% off our standard peak pricing for unemployed, students, over 65, Equity member, and government social services (NHS, Fire Brigade, Police Force, Teachers). Enquire at the desk for more details. Not available on any special offers.
Intro offer is a 20 consecutive days membership for £45. It is valid from first visit and must be activated within one year of purchase. It is not a rolling membership. Only available for new members, can be redeemed only once per person. It can be suspended ONLY for medical reasons (proof required).
